These terms govern this website. They are not the agreement under which we provide the Navisight platform to customers. That is a separate signed contract, and section 7 explains the relationship between the two.
1. About these terms
These Terms of Use apply to navisight.ai and everything on it. By using this website you accept them. If you do not accept them, please do not use the site.
If you use this website on behalf of an organisation, you confirm you are authorised to accept these terms for that organisation.
2. Who we are and how to contact us
This website is operated by Navisight, which provides AI for procurement execution. Our operations run from Dubai, United Arab Emirates, and Colombo, Sri Lanka.
The quickest way to reach us is hello@navisight.ai. Full contact details are in section 19.
3. Changes to the site and to these terms
We may change, suspend or withdraw any part of this website at any time, without notice. We do not guarantee that the site, or any content on it, will always be available or uninterrupted.
We may also revise these terms. The date at the top of this page shows when they were last updated. Continuing to use the site after a change means you accept the revised terms, so it is worth checking this page from time to time.
4. Permitted use
You may use this website to learn about Navisight, to evaluate whether it suits your organisation, and to contact us. You may view, download and print pages for your own internal business use, including sharing them with colleagues as part of an evaluation.
You must not remove any copyright or proprietary notice from material you take from this site, and you must not present our content as your own.
5. Prohibited use
You must not:
- Use the site in any way that breaks the law, or for any fraudulent or harmful purpose.
- Attempt to gain unauthorised access to the site, its server, or any system or network connected to it.
- Introduce malware, or attempt to interfere with the proper working of the site.
- Systematically scrape, harvest, mine or copy content from the site, whether manually or by automated means, or use it to train a machine learning model.
- Submit the demo request form for any purpose other than a genuine enquiry, submit it repeatedly to overload the endpoint, or submit false, misleading or third-party details.
- Reproduce, republish or resell any part of this site commercially without our written permission.
- Impersonate Navisight, or misrepresent your affiliation with us.
6. Demo requests and enquiries
When you submit the demo request form or otherwise contact us:
- You agree the information you give us is accurate, and that you are entitled to give it.
- You understand that submitting the form is an enquiry. It does not create a contract, it does not oblige us to provide a demonstration or a pilot, and it does not oblige you to buy anything.
- Any indication we give about scope, timelines or pricing during those conversations is an estimate for discussion, not an offer capable of acceptance, until it is set out in a signed agreement.
What we do with the information you submit is described in our Privacy Policy.
7. The Navisight platform is governed by a separate agreement
These terms cover this website only. Access to and use of the Navisight platform, including any pilot, trial or production deployment, is governed by a separate written agreement between Navisight and the customer organisation.
That agreement, not this page, sets out service scope, fees, service levels, data ownership and data processing terms, confidentiality, warranties, liability, and how the relationship ends. Where that agreement and these terms conflict on any matter concerning the platform, that agreement takes precedence.
Nothing on this website constitutes an offer to supply the platform, and no statement on this website varies a signed agreement.
8. Intellectual property and brand
We own or are licensed to use everything on this website, including its text, design, layout, graphics, diagrams, product screenshots and code. These are protected by copyright and other intellectual property rights. Except as section 4 permits, no rights are granted to you.
The Navisight name and logo are our trade marks. You may not use them without our written permission, except to refer to us fairly and accurately.
Third-party names and marks
This website refers to third-party products including SAP, QuickBooks, Gmail, Outlook, Office 365, WhatsApp and WeChat. Those names and marks belong to their respective owners. We use them only to describe the systems Navisight works alongside. Their use does not imply any affiliation with, sponsorship by, endorsement by, or partnership with those companies unless we say so explicitly.
9. Third-party links and content
This website links to third-party sites, and displays an accreditation badge served from a third-party server. We provide these for information only. We do not control those sites, we do not endorse their content, and we are not responsible for it. Visiting them is at your own risk and subject to their own terms and privacy policies.
10. Information on this site is general
The content on this website is published for general information about what Navisight does. It is written to be accurate, but it is marketing material rather than a specification.
- Product descriptions and feature explanations describe the product in general terms. What is delivered to a given customer depends on their configuration, their systems and their signed agreement.
- Product screenshots and diagrams are illustrative. They use sample data and do not depict a real customer's purchase orders, suppliers or figures.
- Statistics, industry figures and statements about typical outcomes are drawn from general market observation and our own experience. They describe context, not a promise about your results.
- Statements about our plans or future capability reflect current intent and may change.
We do not warrant that anything on this site is complete, current or free of error, and we may change it without notice.
11. No professional advice
Nothing on this website is legal, financial, tax, compliance or professional procurement advice, and it should not be relied on as a substitute for it. Decisions about your own procurement, contracts, suppliers or systems remain yours. Take your own professional advice before acting.
12. Disclaimer of warranties
To the fullest extent permitted by law, this website is provided as it is and as available, without warranty of any kind, whether express or implied. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
We do not warrant that this website will be uninterrupted, secure or error free, or that it or the server that makes it available is free of viruses or other harmful components. You are responsible for your own device and network security.
13. Limitation of liability
To the fullest extent permitted by law, Navisight and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profit, revenue, business, contracts, anticipated savings, goodwill or data, arising out of or in connection with your use of this website, whether the claim is in contract, tort, negligence or otherwise, and whether or not we were advised such loss was possible.
Our total aggregate liability arising out of or in connection with this website and these terms is limited to one thousand United Arab Emirates dirhams (AED 1,000).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
14. Indemnity
You agree to indemnify Navisight against any claim, loss, liability, cost or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of this website, or your violation of any law or the rights of a third party.
15. Privacy
Our Privacy Policy explains what information we collect through this website, what we do with it, and what rights you have. It forms part of these terms. This website sets no cookies and runs no analytics.
16. Suspension of access
We may restrict or block access to this website, including by blocking an IP address or rate limiting the demo request endpoint, where we reasonably believe it is being misused or where necessary to protect the site. We may do so without notice.
17. General
- Severability
- If any provision of these terms is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the rest will remain in full force.
- No waiver
- If we do not enforce a provision of these terms, that is not a waiver of our right to enforce it later.
- Entire agreement
- Together with our Privacy Policy, these terms are the entire agreement between you and us concerning this website, and replace anything said previously about it. This does not affect the separate customer agreement described in section 7.
- Assignment
- You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours as part of a reorganisation, merger or sale of the business.
- No third-party rights
- Only you and Navisight have rights under these terms. No one else may enforce them.
18. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or with your use of this website, including any non-contractual dispute or claim, are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates.
The courts of Dubai, United Arab Emirates, have exclusive jurisdiction to settle any such dispute or claim.
